Judge spares young defendant because he would be 'raped every day' in jail

A New Mexico judged has spared a young defendant from incarceration because she said he would be "raped every day" if she sent him to jail.

Isaiah Gay(18) appeared in front of the judge charged with burglarizing homes with a group of friends. He faced a maximum sentence of fifteen years in prison.

He told Judge Christina Argyres that he committed the crimes because he was "just being young and dumb", according to the Independent Journal Review, to which she replied "do you know what would happen…to a young a dumb person in prison?"

"You would probably be raped every day, for one".

"He’s going to be somebody’s — I hate to use the word ‘bitch,’ but that’s exactly what he’s going to be".

Judge Argyres told the court she was "willing" to give Gay "a chance" by putting him on five years' probation instead of behind bars.

She warned Gay not to ruin his second chance. "You bow it, it’s on you, not me".
