Sofia Vergara's ex Nick Loeb 'suing to prevent her from destroying embryos made when they were together'

Sofía Vergara’s ex-fiancé is allegedly trying to stop her from destroying embryos made through vitro fertilisation while they were together.

The 42-year-old actress split from Nick Loeb last May and quickly moved on with Joe Manganiello, who she is now engaged to.

In Touch Weekly reports that Sofía and Nick had embryos created from his sperm and her eggs in November 2013, and now the businessman is said to have filed a lawsuit to prevent them from being destroyed.

In court documents obtained by the outlet, Nick - who used the pseudonym John Doe while the actress is named Jane - “seeks to ensure that the Female Embryos are not destroyed, but Jane Doe refuses to agree to their preservation under all circumstances".

While this suit is said to have originally been filed last August, new information has been added and the documents were refiled on April 1 as Nick had hired new lawyers.

In addition to this, Nick claims Sofía was "abusive" towards him during their time together in the documents according to In Touch.

The papers also state the couple used a surrogate twice, but the procedure failed each time.

“Nick has always wanted to be a father and will do whatever it takes to save these two remaining female embryos,” an insider close to the situation tells In Touch. “Nick is very emotionally invested in these female embryos because he’s pro-life and believes life begins at conception.”

The former couple reportedly argued over what would happen to the embryos should they die during their visit to a fertility clinic in California in November 2013. This has also allegedly triggered Nick to sue the centre to prevent them from having any involvement in terminating them.

"Jane insisted that in such a circumstance, the Female Embryos be thawed with no further action,” state the documents. “John did not agree with Jane and refused to initial his agreement regarding that term.”
