Dangerous overtaker

A DRIVER who overtook two cars along a double continuous white line near Grange told Sligo District Court that the road had been clear ahead of him.

Summoned for crossing the white line on March 31st last at Mount Temple, Grange, was Liam Kennedy, Ardfarna, Bundoran.

From his position at the top of the hill near a horse riding centre Garda Brendan Gardiner said he saw Kennedy overtake two cars at a junction.

Kennedy was stopped and a penalty notice was subsequently issued but was not paid.

Garda Gardiner agreed with Mr Gerard McGovern, solicitor (defending), that it was possible the defendant began overtaking along a broken line but ended up continuing the manoeuvre along the continuous line. Garda Gardiner said there was no tremendous speed involved and there were no cars approaching. The defendant said the road was clear ahead of him.

Judge Kevin Kilrane said that stretch of road had been the scene of serious and fatal accidents.

Hatching lanes and continuous white lines had been put in place for a purpose.

He said he hoped the defendant had learned his lesson.

The judge applied the Probation Act.
