Man facING trial over alleged assault at club

A YOUNG man is facing trial accused of assaulting and injuring another man at a west Dublin nightclub.

David Higgins (24) appeared in Blanchardstown District Court on a serious assault charge arising from an alleged incident at a well-known hotel nightspot.

Judge David McHugh adjourned the case against him for the preparation of a book of evidence.

Mr Higgins, with an address at Croftwood Green, Ballyfermot, is charged with assault causing harm to a man.

The offence is under Section 3 of the Non Fatal Offences Against the Person Act and is alleged to have happened at Hush Nightclub, at the Red Cow Moran's Hotel on April 11 last.

The case had been before the court previously and was back before Judge McHugh for the directions of the DPP to be made available.

A state solicitor said the DPP was directing trial on indictment on the assault charge.

This means the case will be sent for trial by judge and jury to Dublin Circuit Criminal Court, which has tougher potential sentencing powers than the district court on conviction.

SOUGHT

The State solicitor said an adjournment was being sought for the preparation of a book of evidence.

Defence Solicitor Lorraine Stephens said she was consenting to an eight week adjournment on the accused's behalf.

Judge McHugh put the case back to a date in September and remanded the defendant on continuing bail.
