Dean's partner sobs as judge allows her to decide burial site

STAB victim Dean Fitzpatrick's funeral will be held on Tuesday.

The 23-year-old, whose funeral arrangements were the subject of a High Court case yesterday, will be removed to the Church of the Holy Trinity in Donaghmede on Monday night with his funeral Mass the following morning at 10am.

Yesterday his heartbroken partner Sarah O'Rourke gave a tearful undertaking in the High Court to look after the funeral which had caused a bitter row between Dean's estranged parents Audrey and Christopher.

High Court President Mr Justice Nicolas Kearns directed that Dean's body should be released by Dublin Coroner Dr Brian Farrell to Sarah as his common-law partner and mother of his 18-month-old son Leon.

The decision ended several days of bitter argument between his parents over where and how the 23-year-old should be buried.

Earlier in the day, Audrey, who had initially wanted Dean buried with her late mother Maura Donohoe in Fingal Cemetery, agreed he could be buried in a new plot in the same cemetery, which was his father Christopher's wish.

The case still came before the court, however, because the couple could not agree who should take charge of the funeral arrangements and therefore, under the law, the coroner could not release the body.

Christopher Fitzpatrick and Sarah O'Rourke took the High Court case seeking release of Dean's body to Christopher for burial. The judge ruled, however, that under law Sarah, as next of kin, could take charge of the arrangements and she agreed.

Dean's body will now repose at Jennings Funeral Home on Oscar Traynor Road in Coolock from 3-5pm today, tomorrow and Monday.

Dean's aunt Christine Kenny, a sister of Christopher Fitzpatrick, said the family was happy "the child will get a proper Christian burial".

"It's just very, very sad. It's unfortunate it had to happen here (in the court) – that we've come as far as this," she added.

Christopher Fitzpatrick said outside the court he was "just happy with the outcome" but Sarah O'Rourke was too distraught to talk.

It was agreed that Dean would be buried in a new grave so his missing sister Amy could be buried beside him if her body was ever found. Amy went missing in Spain in 2008.

Dean (23) was fatally stabbed in an altercation with his mother's partner Dave Mahon last Saturday and had been due to be buried yesterday morning.
