Man armed with a broken bottle tried to steal cash from shop, judge is told

A DUBLIN man is facing a circuit court trial after being accused of using a broken bottle in an attempted robbery at a mobile phone store.

Brian Cairney (27) allegedly went to the Meteor outlet and unsuccessfully tried to take money from the till while holding the bottle.

He was remanded on continuing bail after a judge decided the case was too serious to deal with at District Court level.

Cairney, with an address at Bayside Boulevard South, Sutton, is charged with the attempted robbery at Meteor, North Earl Street, Dublin 1, on December 23, 2010.

A State Solicitor told Dublin District Court the DPP was consenting to summary trial of the case. Asked for an outline of the allegations, she said the prosecution would say the defendant went into the shop and produced a broken bottle, then put his hand into the till.

He was unsuccessful in getting any money.

He left the store without making any verbal threats to staff, and nobody was injured in the incident, the court was told.

Judge Denis McLoughlin refused jurisdiction on the basis of the alleged facts. The case will now be sent forward to Dublin Circuit Criminal Court, where the potential penalties on conviction are more severe.

He adjourned the case to June 8.
