a GP was acquitted of indecently assaulting a 13-year-old girl who claimed he fondled her breasts during a flu examination.

Dr Kevin Mulcahy (56) had denied indecently assaulting the teen 25 years ago and insisted the alleged incident was totally without foundation.

Mulcahy of Cregane, Lombardstown, Mallow, Co Cork, denied the sole charge when his Circuit Criminal Court trial opened on Monday.

A jury of 11 men and one woman told Judge Sean O Donnabhain they were unanimous in finding Mulcahy not guilty.

The complainant, who is now in her late 30s, broke down and sobbed in the public gallery when the verdict was returned.

The doctor was charged with indecently assaulting the girl at his surgery on Strand Street, Kanturk, Co Cork, on a date unknown between September 1, 1989, and June 22, 1990.

The complainant claimed the incident occurred when she attended the surgery for a follow-up check having attended days earlier with her mother.

She had symptoms indicative of the flu or a chest infection.

However, she attended on her own for the follow-up check - and she said there was no one else in the surgery except Dr Mulcahy.

"He [Mulcahy] closed the door. He asked me to take off my top and my bra. I sat sideways on the examination bench," she said.

"He sat behind me. He rubbed my back. He put his hands under my arms and put his hands on my breasts. He fondled and massaged my breasts for what seemed like five or 10 minutes.


"His breathing got heavier and deeper. That is all I could hear," she added.

Dr Mulcahy denied the incident ever occurred.

When first confronted about the allegation in 2011, the GP told Det Garda Colman Murphy he had no idea who the girl was.

Mulcahy later told gardai that the allegation was blatantly false.

He insisted he had no recollection of ever having treated the complainant.
