Dentist settles case of unfair dismissal against ex-colleague

TWO dentists have settled an unfair dismissals dispute involving the question of whether they had worked together as self-employed associates or whether one was an employee, a judge has been told.

Dr Keelin Fox, of Hunters Green, Hunters Wood, Ballycullen, Dublin 24, had brought a compensation claim against Dr John Bailey, Whitehall Road, Dublin 12, which was heard last year by the Employment Appeals Tribunal.

Barrister Kevin Callan, for Dr Fox, told Judge Jacqueline Linnane in the Circuit Civil Court that the Tribunal had ruled against a submission by Dr Bailey that it did not have jurisdiction to hear an unfair dismissals claim by Dr Fox because she was an independent contractor and not an employee.

Michael McNamee, counsel for Dr Bailey, said he was appealing the ruling.

Following a break for talks, Mr McNamee said the matter had been resolved and the parties had reached a confidential agreement.
