A 12-year-old boy, who fell while climbing on a steel frame in an adventure park, has lost a €38,000 damages claim for negligence against his school.
Dylan O'Meara, who has Sotos syndrome and stands 6ft 4ins tall, broke his right leg when he slipped off the rung of a ladder on a climbing frame at Lullymore Heritage and Discovery Park, Co Kildare.
He told the Circuit Civil Court yesterday that in May 2006, while he was climbing down from the play frame, his foot had slipped on a rung of a ladder and he had fallen heavily on to a mattress of tree bark.
Dylan, of Harelawn Grove, Clondalkin, Dublin, who sued through his mother Norma O'Meara, told barrister Imogen McGrath, for St Bernadette's Junior National School, Quarryvale, Clondalkin, that he had fully recovered.
Ms McGrath successfully applied for a dismissal of Dylan's case on the grounds that no case of negligence had been proved against the school.
