TWO men who had been accused of taking part in a late-night street attack on another man who suffered a broken thumb have had their cases dismissed.
Shane Lynch (19) and Kurt Murphy (32) had been accused of assaulting the man, who was allegedly kicked and punched on the ground.
They denied the charges, and Judge Bryan Smyth dismissed the case at Dublin District Court after a prosecution witness did not appear.
Mr Lynch, of Bishop's Court, and Mr Murphy, of Lower Faughart, both Dundalk, Co Louth, had pleaded not guilty to assault causing harm.
The incident was alleged to have happened in Montague Street, Dublin 2, on April 28 last year.
The contested case was due to be heard when Judge Smyth was told a witness was absent. The hearing could not proceed and he dismissed both charges.
It was previously alleged that the man was walking in the street at 5am when some litter was thrown at him.
He confronted two people over this. An altercation took place and it was alleged that the man was punched to the ground and, as he lay prone, was kicked "numerous times".
