€200 fine for failing to obey garda instruction
A man who was intoxicated and failed to comply with the direction of a member of An Garda Siochana to leave an area has been convicted and fined €200, Balbriggan District Court has heard.
Martin McCarthy (30) was leaning against a wall on Drogheda Street and when he was asked to leave the area he said he wanted to stay, the district court was told.
He was arrested and charged by local gardaí.
The defendant, of Craoibhin Close in Balbriggan pleaded guilty at the court to being intoxicated and failing to comply with the directions of gardaí on Drogheda Street in Balbriggan on April 26 of this year.
The court heard that the defendant had one previous conviction for failing to comply dating back to 2013.
Defence solicitor for McCarthy, Fiona D'Arcy said the defendant, who has one child, has notdrank alcohol since his arrest and has subsequently apologised for his actions on the day in question.
Ms D'Arcy told Balbriggan District Court: 'He is not working and he left school at the age of 16.
'He is very sorry and undertakes not to drink again as it leads him into trouble.'
Judge Dermot Dempsey was presiding and after hearing the case, he decided to impose a conviction on McCarthy and fine him €200 for failing to comply and took the offence of being intoxicated in public into consideration.
