€2,750 fine for 'green' diesel

A MAN who ran out of diesel and went to a farmyard and put in some unmarked diesel but later on "put in some proper diesel" ended up with a fine of €2,750.

William Fitzgerald (60) of Finnitters Town, Adare, County Limerick had his vehicle dipped on July 12, 2012 at Lisballyhea, Buttevant.

However, state solicitor Frank Nyhan noted that William Fitzgerald had a previous conviction for unmarked diesel in 2005. However, Solicitor Michelle O'Mahony said, in regard to the 2005 offence, he had pleaded guilty "even though it was another party who had the car at the time".

Ms O'Mahony said her client has had no other encounters with the court system or the gardai. "He has three children in college and that is difficult in the current economic climate," She said.

With a maximum penalty of €5,000 available, Judge Brian Sheridan fined Mr Fitzgerald €2,750.
