Solicitor guilty of misconduct

A BRAY solicitor who lost his client's file and papers has been ordered to pay €7,500 to a compensation fund after being found guilty of misconduct by a disciplinary tribunal.

Michael O'Loughlin, practicing in the firm MDO'Loughlin & Company Solicitors, Parklands Office Park, was also ordered to pay costs of the Law Society of Ireland including witnesses' expenses by the Solicitors Disciplinary Tribunal on October 16 of last year.

The tribunal found that O'Loughlin had misrepresented to the complainant that he had received an offer of settlement of €7,500 plus costs from Ulster Bank 'when in fact he had received no such offer.'

He advised the complainant to accept the offer of settlement and 'ostensibly to compromise his claim,' according to the tribunal.

The tribunal further found that O'Loughlin had mislaid and lost the complainant's file and papers relating to the action and misrepresented to the complainant that he was progressing the action and awaiting a court date, when in fact he had lost the file and not progressed the action other than to issue and serve a civil bill.
