Blood testing plan needs a court test all of its own
IT is essential that there are penalties for refusing to give a blood or urine sample in a case of suspected drink driving. Otherwise, why would anyone who thought they might be over the limit agree to do so?
But there will still be instinctive unease at the proposal to allow samples to be taken from unconscious drivers, who would then be asked, once fit enough to give consent, if they agreed to the sample being tested.
Instinctive but illogical. It does not seem right that an injured driver should escape testing while one who fails a breathalyser test cannot.
