Link whiplash payouts to severity of the injury - report
The sums awarded in whiplash claims should be linked to the severity of the condition, the Personal Injuries Commission has recommended.
The commission was established earlier this year as part of government efforts to tackle rising car insurance premiums.
Chaired by Mr Justice Nicholas Kearns, its first report was presented to Cabinet yesterday.
Among its key recommendations is adopting a standardised approach to the diagnosis, treatment and reporting of soft tissue injuries. It said this will improve the personal injuries environment here.
Training and accreditation of doctors who complete personal injury medical reports should also be put in place, according to the report.
It also recommends the linking of future editions of the 'Book Of Quantum' - a publication that offers guidelines on the sums which may be awarded in personal injury claims - to the severity of injuries. This includes a scale of severity for whiplash, from soft-tissue injuries to more severe Whiplash Associated Disorder.
