Penalty is a €3,000 fine and your freedom

ALTHOUGH the smoking ban has been in force for almost a decade, nobody had been given a jail sentence as set out in legislation, until this week.

Section 47 (1) of the Public Health (Tobacco) Acts 2002/2004 states that any occupier, manager or person who is in charge of the pub, at the time of a smoking offence, is guilty of an offence if he or she is aware of the smoking and fails to make reasonable efforts to ensure it stops and is not repeated.

Section 5 states that a person found guilty of breaching the ban is liable to a fine of up to €3,000 and three months in prison.
