Lissadell couple appeals right of way ruling

A COUPLE who own a stately home are battling to overturn a judge's decision on rights of way through their land, which saddled them with an estimated €6m legal bill.

The Supreme Court was told that Mr Justice Brian McMahon – who decided in 2010 that there were rights of way through historic Lissadell Estate in Sligo – made an error in suggesting there was a right of public access, a court heard.

Brian Murray said that the judge had converted this into a presumption on the law governing rights of way.

He was making submissions on behalf of Lissadell's current owners, husband and wife barristers Edward Walsh and Constance Cassidy, on the opening day of their appeal against Mr Justice McMahon's decision.
