Level of offender is not taken into account – LRC
THE LRC wants the repeal of "mandatory minimum" laws for certain drugs and firearms offences.
Designed to crack down on gangs, people caught in possession of drugs worth €13,000 or over are meant to receive a minimum jail term of 10 years unless there are exceptional and specific circumstances.
The presumptive terms have been criticised for fuelling overcrowding in prisons by failing to distinguish between high and low-level offenders and do not take into account the fluctuating nature of the street value of drugs.
The watchdog says that a more structured, guidance-based system, backed by a judicial council, would provide better alternatives to the presumptive terms.
