Woman got 'nasty bang' from shutter
A woman who injured her face when she walked into a shopfront shutter has been awarded €17,500 damages in the Circuit Civil Court.
Garret Baker, counsel for Yvonne McEvoy (42), said that as she left Tuthills news agents just before closing in Liffey Valley Shopping Centre in October 2010 she had not been warned that the shutter had been lowered almost half way.
Ms McEvoy, of Greenfort Avenue, Clondalkin, Dublin, said her attention had been drawn to Halloween special offers and she struck her face against the shutter.
Judge Jacqueline Linnane said staff routinely partly lower shutters just before closing time to stop people entering. On this occasion it had been negligently lowered and Ms McEvoy had not heard any warning.
The judge said Ms McEvoy suffered a very nasty bang.
