Three teens - including two brothers - appear in court charged with rape of girl (15)
THREE TEENAGERS including two brothers have appeared in Tallaght District Court this morning charged with the rape of a 15-year-old girl in 2016.
The first teenager, aged 17, who has an address in Tallaght, the second teen, also 17, who also has an address in Tallaght, the third teenager, aged 15, who has an address in Dublin and is the second teenager's brother, all appeared separately before Judge Patricia McNamara.
They are all charged with raping the female at a location in Tallaght on January 25, 2016.
The third teenager is also charged with sexually assaulting the same female also on January 25, 2016.
The three teenagers would have been aged 16, 16 and 14 at the time of the alleged incident.
Sergeant Eithne Madden gave evidence of arrest, charge and caution by certificate in respect of each accused. She said the DPP had directed trial on indictment and asked for a remand for eight weeks for service of the book of evidence.
The first teenager appeared in court accompanied by his aunt and grandmother. The two brothers were accompanied by their parents.
Sgt Madden asked that a bail condition be added to each accused directing that they stay away and have no contact with the alleged injured party.
Judge McNamara asked if there would be a Section 75 enquiry under the Childrens Act to try the case summarily in the District Court.
The first teenager’s solicitor, Michael Hennessy, said that due to the nature of the charge, a Section 75 enquiry would not apply and the case would go straight to the Central Criminal Court.
Adding the bail condition, Judge McNamara remanded the three teenagers on bail to a date in December for service of the book of evidence.
