Settlement reached in McCabe libel case against RTÉ and lawyer Gerald Kean

A defamation action taken by Sergeant Maurice McCabe against RTÉ and a high-profile solicitor has been settled.

The lawsuit arose over comments made by solicitor Gerald Kean on the Marian Finucane radio show in 2014.

Mr Kean incorrectly said two Garda whistleblowers who helped expose widespread malpractice in the wiping of penalty points did not co-operate with an internal Garda investigation headed by then assistant commissioner John O'Mahoney.

Sgt McCabe was not contacted by the inquiry team.

The terms of the settlement have not been disclosed.

Mr Kean made the remarks during a panel discussion on January 26, 2014.

They were based on an assertion made in the Dáil by then-justice minister Alan Shatter the previous October.

It is understood Sgt McCabe wrote to Mr Kean afterwards to complain about the comments and that the solicitor apologised if any offence had been caused. However, proceedings were issued by Sgt McCabe against RTÉ and Mr Kean the following year.

Mr Shatter apologised to the whistleblowers in March 2015 and acknowledged his statement had been incorrect.

According to the Courtsdesk.com website, Sgt McCabe has also issued proceedings against 'The Irish Times' and Midlands Radio Group Ltd over different matters.

He also has a second action against RTÉ in which Mr Shatter is also named as a defendant.

Earlier this year, Sgt McCabe and his family issued proceedings against the HSE and Tusla seeking damages over the creation of a file containing a false sexual abuse allegation against him.

He also has a High Court action against the Garda commissioner.

The Disclosures Tribunal is investigating allegations a smear campaign against Sgt McCabe was orchestrated at the highest levels of the force.
