Man who lost temper and kicked van door causing €1,800 of damage gets probation
A MAN who lost his temper and kicked a van door causing €1,800 worth of damage after he claimed his friends were subject of a racial attack has been given the benefit of the Probation Act after he paid compensation.
Chris Iyaba (24) paid the van owner €1,818 in compensation after he pleaded guilty to causing criminal damage to a Transit van at McDonald's car park at Millfield Shopping Centre in Balbriggan on April 27th last year.
Iyaba of The Hastings Lawn, Hamlet Lane in Balbriggan has no previous convictions, Balbriggan District Court heard.
Defence solicitor Eleanor Kelly said Iyaba got himself involved in the incident when he was out with friends.
'His friends were subjected to a racial attack and he lost his temper and kicked the vehicle's door,' said Ms Kelly, asking Judge Dermot Dempsey to be as lenient as possible.
She said Iyaba has plans to go to college in September to study Bio-Science and that he has applied for citizenship but that a conviction may hamper it.
Judge Dempsey applied Section 1.1 of the Probation Act after the compensation was paid over.
