Judge overturns €31,385 award for worker who hurt eye on box
A High Court judge has overturned an award of €31,385 made in favour of a Dunnes Stores worker who bruised her eye when she accidentally brushed against a cardboard box.
Corinne Donnelly, of Shannonbanks, Corbally, Co Limerick, blamed work pressures as the 'legal cause' against Dunne Stores for injuring herself in the accident at the retailer's Harvey's Quay branch in Limerick city on June 14, 2014.
However Mr Justice Michael Twomey said that, had the accident happened at home, "it is likely that it would be regarded as an unfortunate accident arising from Ms Donnelly's lack of attention to her task because she was rushing or otherwise pre-occupied. Indeed, in such a scenario, Ms Donnelly might have blamed herself for the accident."
He overturned a circuit court award of €19,000 for pain and suffering and €12,385 for out of pocket expenses/special damages.
