Judge asked to dismiss claim against State

THE Garda Commissioner and State have asked the High Court to dismiss a claim brought by James Walsh, who says he was the victim of malicious prosecution arising out of his trial for alleged threats to kill journalist Paul Williams.

Mr Walsh was acquitted of the charges in 2007 and has sued the Commissioner, Ireland and the Attorney General.

The defendants contend there was inordinate delay by Mr Walsh, of Dunmore Park, Kingswood Heights, Tallaght, in advancing his civil action.

In an application before Mr Justice Paul Gilligan, they asked to have the matter struck out.

Opposing the application, Mr Walsh's solicitor Anne Fitzgibbon said her client had brought the proceedings within the allowed legal time limits.

The judge said he will give judgment at a later date.
