Guerin asks for Shatter court appeal
Barrister Seán Guerin has asked the Supreme Court to hear an appeal against Alan Shatter's successful challenge to sections of his report concerning the former justice minister's handling of complaints of Garda whistleblower Sergeant Maurice McCabe.
The Supreme Court will decide on a later date whether to hear his appeal. Mr Guerin wants to appeal a decision last November granting Mr Shatter's appeal against the High Court's rejection of his challenge, brought against Mr Guerin only, to the 2014 Guerin report.
The Court of Appeal held Mr Shatter's rights were in jeopardy due to "seriously damaging" conclusions Mr Guerin was to include in his report and Mr Shatter should have been let respond before it was given to the Taoiseach, who later published it.
Yesterday, Paul Gallagher, for Mr Guerin, asked whether Mr Shatter was entitled to go to court to mount a "collateral attack" on the commission.
