A GRANDFATHER was arrested for selling €3 worth of cannabis in a Kinder Surprise egg to an undercover garda, a court heard.

Mark Tobin (44) was left without a drug-dealing conviction when Judge Ann Ryan applied the Probation Act. Tobin, of Gloucester Place, Dublin 1 pleaded guilty to possession of cannabis with intent to sell or supply at O'Connell Street on March 12, 2014.

Garda Joseph Pigott told Dublin District Court the accused approached him on the day and offered to sell him a small quantity of cannabis.

Tobin had previous convictions but none were for drugs offences.

Defence solicitor Declan Fahy said Tobin had the drugs contained in a Kinder egg.

He said the defendant had "succumbed to temptation" and it was at the "lowest scale of supply you could possibly imagine".
