Girl (5) awarded €21,000 for toy store accident

A FIVE year-old girl, who banged her head against a ladder in Smyths Toys store in Blanchardstown Centre, Dublin, has been awarded €21,000 in the Circuit Civil Court.

The court heard that on the September 17, 2008, Martyna Hyrcza, of Balrath Wood, Kells, Co Meath, was shopping in the store with her father Thomas Hyrcza when she walked into the ladder which had not been cordoned off in an aisle.

Circuit Court President, Mr Justice Matthew Deery, was told that little Martyna, who was nearly two-year-old at the time, had been taken by ambulance to Temple Street Children’s Hospital, Dublin. She suffered a three centimetre laceration to the left side of her forehead which was drawn together with glue and Seri-strips.

Through her father, Thomas, she sued the store for damages. The court was told that the store had made a settlement offer of €21,000 while denying liability in a full defence.

Judge Deery who said the wound had left a scar on Martyna’s forehead, approved the offer.
