Fair City star who bit and punched former partner seeks more time to pay compensation
A FAIR City star who bit and punched his ex-girlfriend in an attack at his home is seeking more time to pay compensation, after handing over €1,000 in court.
Patrick Fitzpatrick (33), who is awaiting sentence for the assault, potentially faces a maximum jail term of one year in prison.
His case can only be finalised by the judge who originally heard the facts and it was adjourned for a week at Dublin District Court today.
The court heard the actor, who played Zumo Bishop in the hugely popular RTE soap, is due to pay another €1,000 to the victim.
Fitzpatrick pleaded gulity to assault causing harm to Theresa Gannon at his home at Holly Terrace, Ballymun on September 4, 2015.
The court had heard the victim was at the accused’s home on the day in question when he became aggressive.
He threw two punches at her face and bit her right upper arm. She was left with bruising to her right eye but the bite did not break her skin.
Today, Fitzpatrick’s barrister told Judge Deirdre Gearty there was “a sum of money to be paid” in compensation and €1,000 was handed over to Garda Niall Carolan, to be given to the victim.
Counsel said there was €1,000 outstanding.
She said there was also a probation report on the accused, which referred to a “certain engagement with a particular programme” which did not start until September.
She asked Judge Gearty to adjourn the case until November.
However, the judge noted that the accused had pleaded gulity in February and the case had now been before the court three times to find the judge who heard the case, Judge John Lindsay.
“The reality is, the €1,000 won’t be put together in time for next week,” Fitzpatrick’s barrister said.
Judge Gearty said it was better that Judge Lindsay decides what to do and adjourned the case to July 12.
Fitzpatrick is excused from attending on that date. He did not address the court during today’s brief hearing.
The charge of assault causing harm is under Section 3 of the Non Fatal Offences Against the Person Act, which carries a potential sentence on conviction in the district court of 12 months imprisonment.
Previously, the court heard a pre-sentence probation report had been ordered and this was favourable to Fitzpatrick.
He was remanded on continuing bail.
A medical report on Ms Gannon's injuries was also handed in to court on an earlier date.
Fitzpatrick was last seen on Fair City last year when he returned to the soap for one episode. He had played the Zumo character between 2007 and 2013 before quitting the show.
