Developer loses challenge over Mahon Tribunal

DEVELOPER Owen O'Callaghan has lost a legal challenge to the Mahon Tribunal, which found he was involved in making corrupt payments to councillors.

Mr O'Callaghan (71) claimed the findings were based on vague and uncertain definitions of corruption and the tribunal gave him no opportunity to address the findings before its final report was published.

The tribunal decided Mr O'Callaghan paid Frank Dunlop IR£70,000 in November 1992 to fund payments to politicians.

Yesterday, Mr Justice John Hedigan was satisfied all payments referred to, forming the basis of its findings of corruption, were put to Mr O'Callaghan in such way as to alert him and his legal advisers to the possibility the payments might be found to be corrupt and so as to allow him fully explain.
