Childcare centres pay out €170k in injury settlements

SETTLEMENTS totalling more than €170,000 have been agreed in two separate High Court actions brought on behalf of children who suffered injuries at childcare facilities.

In the first, Mr Justice Michael Peart approved a settlement of €122,000 in favour of Ella Rogerson, who suffered serious injuries after being struck in the eye by a jet of water from a hose at the childcare facility Ella attended at Commons Road, Navan, Co Meath, on June 14, 2010.

Ella (10), through her father Gavin Rogerson, Fitzherbert Court, Slane Road, Navan, Co Meath, sued the operators of Sandy's Childcare Ltd, with a registered address at Grange End, Dunshaughlin, Co Meath, for alleged negligence and breach of duty of care. The claims were denied.

The High Court also approved a settlement of €51,500 for three-year-old Lauren Torpey.

Lauren, through her mother Tara Lillywhite, Frankfort Avenue, Rathgar, Dublin, brought a claim against Giraffe Childcare Ltd arising out an incident on June 2, 2011.

Lauren was in the Namibia Room of Giraffe Childcare, Harcourt Road, when she tripped and hit her head on the edge of a sharp skirting board. She suffered a deep laceration. Mr Justice Peart approved €51,500 in favour of Lauren.
