Boy settles with HSE for alleged birth injuries
A BOY who allegedly suffered an injury to his shoulder during birth has settled his High Court action for damages against the HSE for €275,000.
Sean Daly (now eight) of Kinvara Park, Ballyvolane, Cork, had sued the HSE as a result of the injury allegedly sustained during his delivery at St Finbarr's Hospital, Douglas Road, Cork, on October 8, 2004.
The settlement was without admission of liability.
It was claimed Sean's shoulders were delivered by traction, which was excessive resulting in and a permanent disability.
The HSE had denied that excessive traction was applied, and further denied any negligence or breach of duty.
