Challenge brought against 11 turbine wind farm on land in Cork
A Couple have brought a legal challenge to a decision to grant planning permission for a windfarm development close to their home.
Klaus Balz and Hanna Heubach, with an address at Bear na Gaoithe, Inchigeelagh, Co Cork, have brought High Court proceedngs against An Bord Pleanala over its decision to grant permission for the project at Cleanrath, Inchigeelagh.
Permission to develop a wind farm, consisting of up to 11 turbines, was granted to Cleanrath Windfarm Ltd.
The couple claim the planning authority failed to properly take into account the increased noise that will be generated by the turbines.
They seek an order quashing the decision allowing the wind farm be constructed.
They also declarations including that the board failed to carry out a proper Environmental Impact Assessment before giving the go ahead.
Cork County Council and the Cleanrath are notice parties to the proceedings.
Permission to bring the challenge was granted, on an ex parte (one side only represented) basis, by Mr Justice Seamus Noonan who said the case can come back to court in October.
