Man stabbed to death after asking young father about his crying child
A WELL meaning 63-year-old man was stabbed to death after he challenged a young father over a crying child, the Old Bailey in London heard.
Alan Smith was stabbed five times in front of his partner and daughter as ''revenge'' for asking if everything was alright with the little girl, jurors were told.
He was at the BB Cafe in Leyton, east London on March 26 last year when he asked Matthew Quesada, 26, about the crying child.
Quesada replied: ''What's it to do with you? Go away. What's it f---ing got to do with you?'', the court heard.
Mr Smith was ''eager to avoid confrontation'' and so went with his partner, daughter and son-in-law to the nearby Roma Cafe.
The family had met for lunch to celebrate Mr Smith's daughter's birthday.
Prosecutor Roger Smart said: ''Matthew Quesada, say the prosecution, reacted angrily at the scene and left the cafe in haste, taking his daughter home, a short distance away from the BB Cafe.
''He didn't stay at home however. He left his daughter with his partner Maria Brigette and picked up a knife, intent upon seeking revenge on the deceased.''
Quesada followed the family to the Roma Cafe and wordlessly stabbed Mr Smith five times, jurors were told.
A pathologist found that any one of three of the knife wounds could have killed him.
The next day Quesada was found in a car with his mother Victoria Passley-Quesada, 54, having cut his hair. He had his passport with him and details of flights to Brazil.
Quesada, of no fixed address, is accused of murdering Mr Smith, which he denies.
Brigette, 26, from Walthamstow, east London, and Passley-Quesada, from Purley, south London, are both accused of assisting an offender, which they deny.
It is claimed that Brigette kept Quesada informed about the progress of the police investigation into Mr Smith's death.
The court heard that after the initial disagreement, Quesada shouted after Mr Smith and his family words similar to "You see, you".
Mr Smart said this was "a warning. A man in an aggressive state. A man humiliated, angered by what had happened inside the BB Cafe, bent on exacting his revenge".
Minutes later, Mr Smith was stabbed.
Medics carried out open-heart surgery in the cafe in an attempt to save him, but he was later pronounced dead in hospital.
After the attack it is alleged that Quesada cleaned the knife and wrapped it in a blue plastic bag before hiding it. He also washed his clothes and tried to burn them.
Jurors were told that Quesada accepts that he stabbed Mr Smith, but there is an issue over his mental state at the time of the attack.
