The jockey will have to sit out the Derrinstown Derby Trial meeting at Leopardstown on Sunday, in which Dermot Weld is set to saddle Zawraq after the decision by the Limerick stewards was upheld.

The local stewards found Smullen had ridden carelessly in the closing stages of The Racing Again At Limerick Racecourse on 17th May Handicap on April 25.

Smullen accepted he rode carelessly on Breenainthemycra as he edged out to deliver his challenge and that he had caused interference.

His legal representative Andrew Coonan said Smullen had very few offences relative to the number of rides.

He outlined the possible impact on Smullen the second day of the suspension could have on him and that the penalty imposed was disproportionate.

However, the appeals body of the Irish Turf Club upheld the verdict and ordered Smullen to forfeit his deposit.
