Cannabis pipe found in car

A CASTLEMOYLE Heights resident who was found with a cannabis pipe was fined €300 at Wexford District Court.

Jacek Dziadura (33), 1 Castlemoyle Heights, was charged with unlawful possession of drugs at Michael Street on December 15, 2012.

The court heard that Dziadura was stopped on Michael Street while in his car.

Defending solicitor Ian Ryan argued that there was no reason given by the Garda when he gave his evidence as to why he stopped his client.

Judge Gerard Haughton replied that Mr Ryan never asked the Garda why he stopped his client.

'It's fundamentally unconstitutional what's happening here,' Mr Ryan said.

The court heard that a glass pipe found in Dziadura's possession has trace elements of cannabis in it and Judge Haughton convicted him of the offence.

Superintendent Jim Doyle said the defendant has five previous convictions for unlawful possession of drugs.

Mr Ryan said Dziadura cooperated with the Gardaí. Judge Haughton handed down a €300 fine.
