Man struck in face with bottle in takeaway

A CORK man who hit a man in the face with a glass bottle in a Tralee takeaway after mistaking his victim for a person he'd argued with earlier that evening has been jailed for 18 months.

A CORK man who hit a man in the face with a glass bottle in a Tralee takeaway after mistaking his victim for a person he'd argued with earlier that evening has been jailed for 18 months.

John Casey with an address at 112 Larchfield Common Road, Cork appeared before Judge Carroll Moran at Tralee Circuit Criminal Court on Friday for sentencing having earlier pleaded guilty to producing a weapon and assaulting Derek O'Sullivan of Marion Park, Tralee at New Yorkers Takeaway on Bridge Street Tralee in the early hours of August 24 2011.

The court heard that at around 2.40am Mr O'Sullivan was in the toilets of the takeaway when John Casey, a man he had never met, entered the toilets and approached him claiming that Mr O'Sullivan had made insulting remarks about him.

Derek O'Sullivan said that this was untrue and that he didn't know who Mr Casey was.

John Casey left the toilets and a shortly afterwards Derek O'Sullivan was about to leave when John Casey reappeared brandishing a glass bottle which he used to strike Mr O'Sullivan in the forehead.

Mr Casey left the scene and Derek O'Sullivan was taken to the Emergency Department at Kerry General Hospital where he received five stitches and was discharged.

Gardaí arrested John Casey, who has 75 previous convictions, in Cork the following January. He admitted the assault but initially claimed that he was acting in self defence.

He told gardaí that he had mistaken Derek O'Sullivan for another man with whom he'd had an argument with in a pub in Tralee earlier that night.

In court on Friday Mr Casey handed over €2,000 which his family had collected to offer as compensation to Mr O'Sullivan.

Judge Moran imposed a three year sentence with the final 18 months of the term suspended.
