A 48-YEAR-OLD Killarney native described in court as a chronic alcoholic was arrested for his own safety following a disturbance on Muckross Road, the district court has heard.
Donal Cosgrave, with an address at 16 Woodlawn Park, Killarney, was subsequently found to have a can of pepper spray when searched by gardaí. He said he had the pepper spray for his own safety.
Killarney District Court last week heard that gardaí had been called to the scene on February 1 last, where they found the defendant in an intoxicated state and he was arrested and detained for his own safety. Mr Cosgrave has five previous public order convictions.
Solicitor Padraig O'Connell said the defendant was a long term resident of the US but is currently living at his mother's residence. "He is very much united with his mother who is long suffering," the solicitor continued before explaining how Mr Cosgrave attends Alcoholic Anonymous meetings on a daily basis, followed by evening counselling sessions.
Mr Cosgrave was convicted for possession of pepper spray and fined €450, while a charge of intoxication in a public place was taken into consideration.
