Landlord's €6,075 penalties for failing to register tenancy

A WEXFORD landlord has been fined €3,000 with €3,075 in legal costs for failing to register a tenancy.
John Cooney, Bulgan, Glynn was convicted in the Dublin Metropolitan District Court for failing to register Flat 1, Shortcourse, Waterford as a rental property in which a tenancy existed.
The case was brought by the Private Residential Tenancies Board which is a statutory agency that maintains a register of all private rented accommodation.
In a statement regarding the case, the PRTB said the Wexford landlord failed to register the tenancy despite a number of statutory notices and warning letters instructing him to do so.
It said the court noted the ' less than nominal' cost of registering a tenancy in the context of the potential penalties for non-compliance.
The court also noted that the defendant had been given every opportunity to comply with registration requirements both by the Board and by its solicitors before the commencement of the prosecution.
The PRTB issued over 43,000 letters during 2012 notifying landlords of their registration requirement. The registration fee is €90 per tenancy. The Board said the letters were sent out on foot of information from the Department of Social Protection under data exchange from the Rent Supplement application database.
