Mallow child porn man's probation report is 'not bad'

A MAN in his 40s who pleaded guilty to possession of child pornography on his mobile phone - which featured an image of a six year old child being raped - was told by a judge this week that his probation report was "not bad".

The accused - from the Mallow area - had pleaded guilty at a previous sitting of Mallow District court to having child pornography on his mobile phone when Gardai went to his home on September 4, 2012.

Garda Anthony Daly had given evidence at a previous sitting where he said there were 53 images and videos on the man's mobile phone.

Garda Daly said the images had been stored in specific folders and one image featured the rape of a six year old child. Garda Daly also said there were images which also featured babies and teenagers.

"He said that he (the accused) had obsessive compulsive disorder and he had put the images into various folders," said Garda Daly.

"It was horrific images. The images were disturbing," said Garda Daly.

Judge Brian Sheridan requested a probation report be undertaken on the man. At a sitting of Mallow District court in April 2013, the probation report on the man was found to be "quite favourable".

"There is a programme available and the accused is anxious to participate in it," said solicitor Charlie O'Connor in April. Mr O'Connor had told Judge Sheridan that his client was agreeable to all suggestions in the report.

Judge Sheridan then put the matter in for review this week.

On Tuesday, Judge Brian Sheridan read the newly furnished report and said to solicitor Denis Linehan (acting for Charlie O'Connor) that he should convey to Mr O'Connor that the report was "not bad".

The case will be re-entered later this month.
