Psychiatric patient secures freedom from hospital
THE High Court has ordered that a man in urgent need of psychiatric care be released from the hospital where he had been involuntarily detained.
The man, who slept with a hammer by his bed and his head wrapped in tin foil, was detained under the 2001 Mental Health Act earlier this month.
Lawyers acting on his behalf claimed he could not be involuntarily detained in a psychiatric hospital without a prior recommendation from a registered medical practioner. Lawyers for the hospital had opposed the action, and argued that the detention was valid.
But Mr Justice Gerard Hogan agreed the man's detention was not in accordance with the law and ordered his release.
