O'Brien considers fresh legal challenge
BUSINESSMAN Denis O'Brien is expected to launch fresh legal proceedings against the Moriarty Tribunal in the wake of its report. The tribunal is already defending four sets of legal proceedings brought by him previously.
Although no final decisions have been reached by Mr O'Brien and his advisers, it is understood that judicial-review proceedings are being contemplated. These may seek to challenge the tribunal's findings and the standard of proof applied to the statements and evidence obtained by the inquiry.
Mr O'Brien, who has welcomed a referral of the report to the DPP by Taoiseach Enda Kenny, has claimed that the report is "based solely on 'opinions' which find no basis in evidence, fact and law".
