Gardai challenge discipline probe

FOUR gardai who were acquitted of assault are challenging the conduct of internal garda disciplinary proceedings against them.

Garda Alan Conlon, Garda Eoin Murtagh, Garda Claire Delaney and Garda Sean O'Leary were informed last month that the Garda Commissioner had appointed a chief superintendent to investigate alleged breaches of garda discipline by them.

Earlier this year a jury at Dublin Circuit Criminal Court unanimously found all four not guilty of forcing entry to a flat in Dublin and trespassing and assaulting Owen Gaffney (21) on February 17, 2008. They were also acquitted of false imprisonment. The gardai had denied all the charges.

Mr Justice Michael Peart granted the four gardai leave to bring the challenge, and the matter will be dealt with next month.
