An Garda Siochana has commenced a review of prosecutions in relation to all fixed charge offences, it confirmed in a statement this evening.
It has been discovered that prosecutions were taken for the offence of having no NCT Certificate where the fine had already been paid, the statement said.
“As a consequence of this, a review of prosecutions in relation to all fixed charge offences has commenced,” the statement said.
“The purpose of the review is to establish the full extent of the issue and to ensure that action is taken to prevent reoccurrence and address the consequences of any prosecutions which were incorrectly taken.”
Meanwhile, district officers have been directed to withdraw the prosecution of any such future cases.
“An Garda Síochána will, in consultation with the Director of Public Prosecutions, bring any matters to the attention of the courts as required.”
“Any inconvenience caused by this issue is regretted and any person affected will be notified by An Garda Síochána in writing,” a garda spokesperson said.
“An Garda Síochána wishes to reassure people affected that all appropriate action is being taken to remedy matters.”
