Garda 'tried to force abortion on woman who he impregnated'

Foreign national: officer threatened to have me deported

THE Garda Ombudsman is investigating a claim by an Eastern European woman that she became pregnant by a senior garda and that he tried to procure an abortion for her.

The Sunday Independent has heard taped conversations between the woman and the married officer as they discuss her taking abortion pills he acquired over the internet. She claims she was intimidated by the garda when she refused to do so and that he threatened to have her deported.

The woman, who is in her 30s, recently gave birth to a baby daughter and the child was taken into care. Her three-year-old son, who she says was also fathered by another garda, was also taken from her into the care of the HSE.

She is now mounting a legal campaign to have the children returned and to have their parenthood confirmed and to receive maintenance.

The woman taped prolonged phone conversations with the senior Dublin garda who, she says, made her pregnant during a one-night stand in the back of his car in a car park in Ballymun, Dublin, last October. She says they were interrupted during the brief tryst by two uniformed gardai in a patrol car and that the officer showed these gardai his identity.

The woman has applied to the garda authorities to have the two gardai who came upon her and the senior officer to be identified and for them to give evidence of the incident. She says that when she contacted the senior garda, he tried to force her to take abortion pills he acquired over the internet from the site Women on Web. He told her in the conversations he paid €90 for the pills.

The woman was interviewed at length last Tuesday and Wednesday by investigators from the Garda Ombudsman's office. A spokesman refused to comment.

The woman claims she pretended to take the first of five abortion pills when she met the officer in Dublin city centre last November after she informed him of her pregnancy. She claims the garda gave her the pills and watched as she took the first one. She said she kept this pill in her mouth while pretending to swallow it. The other pills were to be taken afterwards and she says she kept these.

She taped three phone conversations with the officer during the period she claims he was pressurising her into taking the abortion pills, Mifepristone, which is taken orally, followed by four Micoprostol tablets, taken vaginally.

In the taped conversation last November the garda asks if she had taken the rest of the pills, apparently believing she had swallowed the first abortion pill.

The garda adds: "Yes, and you said you'd take the rest of the pills today."

The garda says that the second course of pills "are to help the thing to move out of your body".

The woman objects to the term "thing" and says: "It's a baby (his forename), it's a real baby, it's not a 'thing'."

She points out that the package says that the pills should be taken under medical supervision and that she would like to go to a hospital.

But the garda replies: "No, we can't do it in a hospital."

When she asks why not, he replies: "Because it's illegal."

Later in the conversation the garda accuses her of stealing money from him, which she denies, claiming she took only €15 from him after he had given her another €100. He says he has difficulty providing money as he has a joint bank account with his wife.

The woman came here a number of years ago with her former husband. She says a child by this marriage is now in care in another European country. She left her husband shortly after arriving in Ireland.

It was at this point, she says, that she was approached by an unmarried garda, based outside Dublin, seeking a sexual relationship. She has kept notes of lewd texts which, she says, this garda sent her. She says she finally slept with him and became pregnant with a son. In some of these texts there is a request for her to take part in a "threesome" with another woman.

The woman subsequently moved to Dublin and says she met the senior officer through contact with his office. She says she finally agreed to meet him after he offered to give a lift to a young woman who was visiting her from abroad. She said she consented to have sex with him that night and did so in his car. She said she was naked except for a raincoat in the back of his car when the two patrol gardai came to the car. She said after the officer showed the two his identity they left.

During one of the taped conversations she asks if the gardai will deport her from Ireland, but the officer reassures her that this will not happen.

“That’s only because I was passing time because I was here waiting for you, so.”

“Yeah, but how did, why didn’t you ring me then?”

“Because I rang you and you said ring me back in an hour and I said…”

“I was in Tesco at the time.”

“I said I’ll wait around the area and I’ll ring you later.”

“Yes.”

“That’s why I went to Aldi to look at that stuff, then I came in the park in the hotel.”

“What did you do in Aldi exactly? Did you buy anything there?”

“No, I didn’t buy anything there. I looked at all the, I looked at all the, you know, the tools and all that stuff.”

“Hmm”

“Why:”

“I always do that, look at the offers. You know the way they have special offers on for tools and clothes, I was just having a look around.”

“Yeah, yeah. Yeah, yeah. OK, so, um, so, what is latest time we can meet because I need to have some food before I come down because I feel very dizzy, very sick. I need to go to the hospital maybe. That pill what you gave me was not good at all.”

“And, have you had any bleeding, no?”

“No.”

“No, not yet?”

“But I did throw up loads of times.”

“Did you?”

“Yeah, and I had pressure in my belly and I had, you know, other stuff, so I am very sick. So, I don’t hope that this pill is gonna give me some real problems.”

“No, it won’t, no.”

“No, no, it won’t, how do you know that so sure?”

“Because I have researched everything…”

“Where did you buy this? Where did you get this then?”

“From that website I gave to you yesterday.”

“Where are they?”

“In Holland, I think.”

“You want to have my baby but you don’t want to meet me. That doesn’t make sense.”

“Oh no. I know it doesn’t, no, but, uhm, I don’t know. So, you know, the baby is already there and I don’t can’t change that.”

“Yeah, but we need to talk.”

“I don’t know, but , like you know, if it’s a good idea to, you know, to meet, you know, so, uh, so maybe it’s better to wait until the child is nearly there. I don’t know.”

“Why?”

“I don’t know, because, I don’t know if I am going to stay in Ireland or not. I might emigrate, I might, I don’t know yet, I don’t know..”

“Where would you go?!

“I don’t know yet because I don’t have any family in Ireland. I don’t have anybody.”

“You have nobody anywhere, have you?”

“Not in Ireland.”

“Where have you family?”

“Where? I have only my aunt and my niece and my uncle. That’s all…”

“Where are they?”

“(she names her native country)”

“OK, well I still want to meet you, so if you decide to meet me will you ring me so.”

“Uhm, I don’t know because, you know, I don’t see any point of meeting up with you. I mean, you know,  there is no any hope for me or the child. I mean that’s, that’s obvious. There is nobody here to support me or the baby,so…”

“How can you leave?”

“How do you mean, how could I leave?”

“You have no passport for your older baby.”

“No, but that’s no matter, I can fix that.”

“How?”

“I won’t put (she name’s a man) name on the birth certificate. That’s all that I have to say.”

“You won’t?”

“No, no, I have a good thought and he is just a bastard and he doesn’t deserve to be on my son’s birth certificate at all.”

 (Her baby son begins saying “mamma” “mamma” animatedly)

“OK, your son sounds very happy anyway.”

“Yeah, you know, I have been struggling in Ireland for years, yeah, without any means of support, no help from anybody. The only one friend who is a guard, he was the only one who was helping me out without anything in exchange, you know, he doesn’t ask for anything, no sex, nothing, so I don’t know, so…”

“OK”

“But, I don’t know,  you know, I hear a few things about you as well and about your wife…”

“What did you hear?”

(deleted)

“Uh, yeah.”

“And, I know her name as well.”

“Do yeh?”

“Yes, but I don’t care, because…”

“Who have you been talking to?”

“It doesn’t matter, but…”

“I hope you haven’t been telling people about this, have yeh?”

“No, of course not. I just found out myself.”

“From your garda friend?”

“No, of course not. He doesn’t know anything about you. He doesn’t even know that I am pregnant.”

“So, who else would have known me, who else do you know that knows me?”

“No, I just found out through the Internet.”

“Did yah?”

“Yes. But, it doesn’t matter OK. I mean, I won’t do anything with it because, you know, you are a good man and you always treat me with respect.”

“But, I always will.”

“Yeah.”

(Infant begins chattering again)

“You know…”

“I have somebody here waiting to see me. I’m going to have to do.”

“Oh, are you?”

“Yeah.”

“So, what are we going to do then?”

“That’s up to you, you, better you make up your mind and let me know.”

“No, it’s up to you. It’s also your child.”

“What do you mean, what are we going to do?”

“No, what is your plan for the baby?”

“Sure, I have no plan. You won’t let me, you won’t even meet me. I have no plan to do anything.”

“Yeah, I know, but, what do you want to do if the baby is there, I mean, do you want to bond with the baby or do you want avoid the baby, like do you want to take a distance?”

“(her name), I honestly don’t know. This is all, fucked my life, this has fucked my whole life up, I don’t know what  I want to do, you know that.”

“You know, you better be honest to me because then I know what I have to do. If I have to do.”

“I am being honest with you. I don’t know what do to.”

“I don’t want to wait…”

“I can’t sleep. I can’t do anything. This has wrecked my whole life.”

“Look. The one and only thing what I want to know is, do I have to emigrate or what?”

“I can’t tell you that.”

“No, it is. You can because it is also your child.”

“How can I tell you that. It is up to you.”

“No, it is also to do with you for the rest of your life, you know…”

“(her name), I have only met you once. I don’t even know your well. I can’t make that decision.”

“OK, but, the child then?”

“What about the child?

“I mean in June or July, it is going to be there, so.”

“Yeah.”

“So.”

(child laughs and says mammy)

“I mean, what do you want? Do you want born in Ireland or, you know my credit has gone…”

“That’s up to you. I don’t know.”

“What do you want to do then?”

“That’s a matter for you. You won’t allow me have any say in this matter.”

“Oh, I do, I always, that’s why I am ringing you.”

“Well then meet me and we’ll talk about it.”

“Yeah, OK. So, when can I ring you for the meeting…”

Call ends with mobile operator voice call: ”You do not have enough credit….”
