Mr Hogan (39) of Knockdalton, Nenagh, Co Tipperary had sued Edmund Ryan of Duala Village, Cashel, Co Tipperary as a result of the accident in Co Tipperary on September 4, 2008.

Mr Hogan who was a passenger in a van driven by another person was dozing in a back seat when the accident occurred.

The van Mr Hogan was in careered across the road on impact and went through a wall. Mr Hogan's knee struck the seat in front of him and he suffered knee and back injuries.

Ms Justice O'Malley, awarding Mr Hogan a total of €158,0000, said he already had to have one operation on his knee and he may also have to have further surgery.
