Sex offender to serve 15 years for new rape ordeal

A MAN jailed for 15 years for a terrifying rape in a public toilet was a known sex-offender in his native Poland.

Przemyslaw Jakubowski (36) had been convicted of attempted rape and robbery before arriving in Ireland to work in the construction industry.

The Central Criminal Court was told yesterday how on March 9, 2010, Jakubowski subjected a woman in Kanturk, Co Cork, to a terrifying ordeal after grabbing her from behind as she was drying her hands in a public toilet. He then pulled her into a cubicle and threatened to kill her.

The accused was wearing women's underwear at the time, which was later found in his apartment by gardai.

The judge, Mr Justice Patrick McCarthy, said the offence was one of the most serious to come before the courts in recent times.

He said it was "deeply worrying" that Jakubowski was previously convicted for attempted rape in Poland.

In a letter to the court, the 31-year-old victim told how her life has been "turned upside down" by the attack.

"I was raped not once, not twice -- but so many times and in so many ways," she wrote.

"These images haunt my nights, my days, my fears and my realities. After the attack I had to face my daughter who had just come out of school.

"I will never forget the look on her face when she saw the state of me and not being able to explain to her what had happened to me.

"I was in fear of losing my life that day. I always had myself down to be a tough, strong person but I was no match for him that day."

Jakubowski, of Egmont Court, Earl Street, Kanturk, was convicted at a hearing in May of 11 counts and found not guilty, by direction of the judge, of one count of oral rape.

The accused held his head in his hand and muttered to himself as the verdicts were read out.

The court heard he placed the victim in a headlock and locked the door before pushing her head against the cubicle wall.

He told her to "pull down your pants or I'll kill you".

Over the next 40 minutes he repeatedly raped her.

Tim O'Leary, defending, said he was not able to offer much mitigation because his client did not accept the trial verdict.

Mr Justice McCarthy said that Jakubowski "gratified himself in an abnormal manner" during the assault by wearing women's clothes. He said this was an aggravating factor.

The judge noted the victim has been "rendered into a changed state" and has suffered deep stress and psychological scarring.

"One can only hope that the victimisation she suffered resulting from this trial is coming to an end," Mr Justice McCarthy added.

He jailed Jakubowski for 15 years and placed him on the sex offenders' register.

Background checks are only carried on foreign workers when they are applying for a job that will bring them into in close contact with children or vulnerable persons.

Last night the Dublin Rape Crisis Centre (DRCC) commended the victim for reporting the crime to gardai and "staying the course" throughout the whole prosecution.

"The 15-year sentence shows how important it is for victims to stay the course," said Ellen O'Malley Dunlop, chief executive of the DRCC.

The centre also renewed appeals for victims of rape and/or sexual violence to use its 24-hour national helpline at 1 800 77 88 88.
