Murder trial adjourned after court told that defendant died this morning

THE TRIAL of two brothers charged with the murder of teenager Toyosi Shittabey was adjourned today when the judge was told that one of the defendants died this morning.

Paul Barry (39) of Pearse Street, Dublin and his brother Michael (24) were accused of the murder of the 15-year-old schoolboy on April 2 2010.



However Prosecution Counsel Brendan Grehan SC told the Central Criminal Court that there had been developments and Defence Counsel Patrick Gageby SC said he had been instructed his client was deceased.



Mr Justice Paul Carney ordered that the indictment to be marked that the accused was dead.



The court heard that Michael Barry had been informed in a phone call that his brother was dying or deceased at St James’s Hospital and he had gone straight there.



He was remanded on continuing bail and the case was adjourned to the next court list to fix a new date for hearing.
