Man goes on trial for sexual abuse of nephew 20 years ago

A DUBLIN man has gone on trial at the Central Criminal Court accused of sexually abusing his nephew over twenty years ago.

The man, who can not be named for legal reasons, has pleaded not guilty to a total of 44 counts which include 13 counts of indecent assault, 12 counts of indecent assault, 8 counts of sexual assault and 11 counts of rape at locations in Dublin and Mayo on dates between 1989 and 1992.

The boy was aged between 12 and 16 years old at the time of the alleged offences.

The now 36-year-old complainant told Isobel Kennedy SC, prosecuting, that he had stayed overnight at his uncle’s house following a school play on a Saturday evening in 1989 in order to help him with tasks the following day.

He said at bedtime he went to the man’s room and fell asleep. He was awoken to find the accused performing oral sex on him and fondling him. He said he didn’t know how long it had been going on but thought it lasted 10 to 15 minutes.

His uncle said nothing to him then or the next day.

He said he remembered further similar occasions of alleged abuse by the accused after the Ireland vs Holland football match in 1990 and also after they had been to see the movie “Kindergarten Cop” in the cinema.

He said he would stay over at his uncle’s house once every six weeks to two months and the incidents happened every time he went there.

He told Ms Kennedy that in 1992 he went with his grandmother and the accused man to visit Westport. He said they stayed in a rented house and he slept in his uncle’s bed.

He told Ms Kennedy that soon after the incident following the school play his uncle had taken him in his car to the Phoenix Park where he gave the boy pornographic magazines to look at while he performed oral sex on him.

He said on another occasion in his uncle’s bedroom the man set up a live feed to the television in the room and had sex with him while watching the feed on the television. He said he was not aware if it was recording.

He said at another time his uncle had gay pornography on the television and fondled him at the same time.

He told Ms Kennedy that he had never consented to what was going on and the occasion in the rented house in Mayo was the last time he had sexual contact with his uncle.

The trial continues before Mr Justice Barry White and a jury of two women and ten men.
