Lotto-scam accused cleared

THE trial of a man accused of stealing from his local GAA club in a lotto scam has collapsed.

Judge Desmond Hogan yesterday directed the jury at Dublin Circuit Criminal Court to return a not guilty verdict on all counts after considering submissions from prosecution and defence counsel at the close of the State's case.

The judge explained that the prosecution's evidence "fell short of the standard that must be met in a criminal trial" and would have forced the jury to base a verdict on suspicion or conjecture.

Michael Kirk (49), of Tullyallen, Carrickmacross, Co Monaghan, had pleaded not guilty to various charges including two charges of theft from Magheracloone GFC in 2005.
