The jury in the trial of a man accused of the 2011 murder of 29-year-old Adil Essalhi has been discharged.
Michael Kinsella (22), with addresses at Swiftbrook Close, Tallaght and Ardkeen in Cavan had pleaded not guilty to murdering Mr Adil Essalhi at Tyrrelstown, Dublin on January 6th, 2011.
His uncle Wayne Kinsella was convicted of killing Mr Essalhi in 2012.
Miss Justice Deirdre Murphy told the jury of five women and seven men that one of their members would not be able to return.
"One of your members has called in sick and the situation is that they will not be able to return," she said.
"The court is reluctant to proceed with just 11 of you. What I am proposing to do is discharge you as a jury," she continued.
Miss Justice Murphy thanked the jury for their attendance saying: "these things happen, we can't do anything about it".
